Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Zestbird AI web application and related services ("Service") operated by Zestbird AI ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

1. Description of service

Zestbird AI is an AI agent that helps exporters and manufacturers identify potential US importers (buyers) by analyzing US customs bill-of-lading import records. The Service uses artificial intelligence to map product descriptions to import patterns, score buyer fit, and generate draft outreach emails.

2. Account registration

You must sign in with a valid Google account to access core features of the Service. You are responsible for maintaining the security of your account and for all activity under your account. You must provide accurate information and notify us of unauthorized use.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Scrape, resell, or redistribute customs data or search results in bulk without authorization
  • Send spam, harassing, or deceptive outreach to importers identified through the Service
  • Attempt to bypass rate limits, authentication, or security controls
  • Reverse engineer, decompile, or attempt to extract source code or models
  • Use the Service to compete with Zestbird by building a substantially similar product using our data or outputs

4. Customs data and accuracy

Import data displayed in Zestbird is derived from US bill-of-lading records and other public sources. We do not guarantee completeness, accuracy, or timeliness of this data. Importer contact information may not be included in customs filings. You are responsible for verifying information before conducting business outreach.

5. AI-generated content

Fit scores, buyer rankings, and email drafts are generated by AI and may contain errors. You must review all AI outputs before use. We are not liable for business decisions made based on AI-generated content.

6. Email drafts — no sending

Zestbird provides email draft text for you to copy and send from your own email account. We do not send emails on your behalf, provide email delivery infrastructure, or guarantee deliverability. You are solely responsible for compliance with CAN-SPAM, GDPR, and other applicable laws governing commercial email and data protection in your outreach.

7. Subscription and billing

Paid plans are billed monthly or annually as selected. Prices are listed on our pricing page and may change with notice. You may cancel at any time; cancellation takes effect at the end of the current billing period and you retain access until then.

All subscription payments are final. We do not offer refunds except where required by applicable law. By completing checkout you acknowledge and agree to this no-refund policy.

8. Rate limits

We enforce per-user daily limits on searches and email drafts to ensure fair use and control costs. Limits vary by plan. Exceeding limits may result in temporary restriction until the next day or plan upgrade.

9. Intellectual property

The Service, including its design, code, branding, and documentation, is owned by Zestbird. US customs import records are public data; we claim no ownership over underlying government filings. You retain ownership of content you input (product descriptions, etc.).

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT RESULTS WILL LEAD TO SALES OR BUSINESS RELATIONSHIPS.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZESTBIRD AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your access for violation of these Terms or for any reason with notice. You may stop using the Service at any time. Upon termination, your right to use the Service ceases immediately.

13. Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Disputes shall be resolved in the state or federal courts located in Delaware.

14. Changes

We may modify these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via the Service or email.
